ADVICE FOR WHAT TO DO IF YOU ARE STOPPED

If you are pulled over by the police, here are several ways to protect yourself:


  • Stay calm and polite: Nervousness can be misinterpreted by police officers as a sign of intoxication. Maintain your composure and be respectful to avoid raising suspicions.
  • Keep your glove box organized: An organized glove box allows you to quickly and calmly present your registration and insurance without fumbling, which can be misconstrued as a sign of impairment.
  • Refuse vehicle searches without a warrant: Do not consent to a search of your car. Any evidence found can be used to support a DUI conviction.
  • Do not perform field sobriety tests: Field sobriety tests are voluntary, not mandatory. You may still be arrested if you refuse to perform the tests. However, under TN law, you can pass the field sobriety tests and still be arrested for DUI. Additionally, field sobriety tests can be difficult to perform especially with heightened nerves associated with being pulled over.
  • Do not consent to a blood or breath sample: Under the implied consent law, refusing to provide a sample can result in license suspension. However, it will be much more difficult for the State to convict you if they do not have any evidence to use against you.
